These Terms & Conditions govern the rental of Villa Melusina. By making a reservation or staying at the property, you agree to be bound by these Terms & Conditions.

Booking & Eligibility The primary guest must be at least 25 years old. The person making the booking is responsible for all guests staying at the property and for ensuring compliance with these Terms & Conditions. Maximum occupancy is [X] guests. Exceeding this limit is grounds for immediate termination of the stay without refund.

Minimum Stay In accordance with City of Cape Coral regulations, a minimum stay of 7 nights is required for all reservations.

Check-in & Check-out Check-in is from [3:00 PM] on the arrival date. Check-out is by [10:00 AM] on the departure date. Early check-in or late check-out may be available upon request and subject to availability.

Payment Terms A deposit of 35% of the total booking amount is due at the time of reservation to confirm the booking. The remaining balance is due no later than 30 days before the arrival date. Failure to complete payment within this timeframe may result in cancellation without refund.

Payments may be made via bank wire transfer, credit card, or other methods offered through the booking system. A reservation is not confirmed until payment has been received and cleared. Guests are responsible for any transaction or processing fees charged by payment providers or banks.

Cancellation Policy Cancellation terms are communicated at the time of booking and form an integral part of this agreement. Any refunds are subject to those stated conditions. In the event of early departure, no refund will be issued for unused nights.

Force Majeure In the event of a mandatory evacuation order, natural disaster, or other force majeure event that renders the property uninhabitable or inaccessible, guests will receive a pro-rata refund for any unused nights. The owner assumes no liability for losses, costs, or inconveniences resulting from such events.

Loss Damage Waiver (LDW) & Security Deposit A Loss Damage Waiver (LDW) may be included or offered at the time of booking to cover accidental damage up to a specified limit. LDW does not cover intentional damage, negligence, misuse, missing items, excessive cleaning requirements, or violations of house rules.

A security deposit may be required, and the amount varies depending on the length of stay. The owner is authorized to deduct costs for repairs, replacements, missing items, excessive cleaning, and energy consumption from the security deposit. Any costs exceeding the security deposit or not covered by the LDW remain the responsibility of the guest.

Electricity Electricity is charged at $0.20 per kWh based on actual consumption. Usage is calculated from meter readings taken at check-in and check-out by property management and billed accordingly.

Use of Property & Liability Guests use the property, pool, dock, waterfront, and all facilities entirely at their own risk. Children must be supervised at all times, particularly around the pool and waterfront areas. The owner assumes no liability for accidents, injuries, illness, or loss of personal belongings during the stay. Guests are advised to arrange their own travel insurance.

Pool & Waterfront Safety The property features a private swimming pool and direct canal access. Guests acknowledge the inherent risks associated with these facilities and agree to the following rules:

  • Children under the age of 14 must be supervised by a responsible adult at all times when in or near the pool or waterfront area. Adult supervision means being physically present and attentive — not inside the property.
  • The pool area must not be used between [11:00 PM] and [8:00 AM] out of respect for neighboring residents.
  • Diving, jumping from elevated surfaces, or any activity that may cause injury is strictly prohibited.
  • Glass containers are not permitted in the pool area.
  • Guests must shower before entering the pool.
  • The dock and canal area must be used with caution. Swimming in the canal is not recommended due to local wildlife, including alligators, turtles and other aquatic animals.
  • The owner assumes no liability for accidents, injuries, or incidents occurring in or around the pool, dock, or canal.

Right of Entry The owner or property management reserves the right to enter the property with reasonable prior notice for inspections, maintenance, or emergencies. In the case of an emergency, entry may occur without prior notice.

House Rules No parties or events are permitted. The property is located in a quiet residential neighborhood and noise must be kept to reasonable levels, particularly between 10:00 PM and 8:00 AM. Smoking is strictly prohibited inside the property. Pets are not allowed. Please treat the property and its contents with care.

Booking System & Accuracy Availability, pricing, and reservations are managed through an online booking system. Errors may occasionally occur. We reserve the right to correct any inaccuracies and, if necessary, to cancel or adjust affected bookings, with a full refund issued where applicable.

Governing Law These Terms & Conditions are governed by the laws of the State of Florida, United States. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Lee County, Florida.

Privacy Personal data collected during the booking process is processed in accordance with our Privacy Policy, which forms an integral part of these Terms & Conditions.
